Advertising Terms and Conditions
TERMS & CONDITIONS
This agreement represents the complete agreement and understanding between
ETHIO.COM (hereinafter called the vendor) and the purchaser and
supersedes any other written or oral agreement. Upon notice on-line and
by direct mail the vendor reserves the right with 30 day notice to modify
these terms and conditions, amplify them, and/or modify the prices, as
well as discontinue or change the services offered.
1.0 PROVISION OF SERVICES
1.1) ETHIO.COM will provide services on its host computing systems
to individual purchasers in exchange for payment of fees and compliance
with the terms and conditions of this document.
1.2) ETHIO.COM services are defined as the use by the purchaser
of computing, telecommunications, software, and information services provided
by ETHIO.COM.
1.3 ETHIO.COM will publish a notice of fee
increases 30 days before such increases take effect.
2.0 USE OF MATERIAL
2.1) Public Domain materials (e.g., images, text, & programs) may
be used in formatting your ad. The purchaser assumes all risks & liabilities
regarding the determination of whether the material is in the public domain.
2.2) As provided by Canadian and U.S. federal law and by International
treaties, copyrighted materials (e.g. images, text, & programs) may
not be copied using ETHIO.COM services without the permission of
the copyright holder in writing. Copyrighted material may not be changed
nor can the author attribute notices nor the copyright notices be modified.
3.0 USE OF SERVICES
3.1 ) The purchaser agrees to use the services of ETHIO.COM
as permitted by Local, Provincial, Federal and International laws. The
purchaser agrees, therefore, not to use these services to conduct any business
or activity that is prohibited by law.
4.0 INDEMNIFICATION
4.1) The purchaser agrees to indemnify and hold ETHIO.COM harmless
from any claims, including attorney's fees resulting from the purchaser
receiving ETHIO.COM services which cause direct or indirect damage
to another party.
5.0 PAYMENT OF FEES & PENALTIES
5.1) The ETHIO.COM accounting cycle begins on the 1st of each
month. Charges for new accounts are prorated. Charges for terminating are
not.
5.2) Service payments will be submitted in advance of receiving services.
5.3) Payment is due at the beginning of each month.
5.4 ) Delinquent accounts are those that remain unpaid 5 days after
the beginning of the month. These accounts will incur a 2% interest charge.
5.5) Accounts that are delinquent are put on "accounting hold"
and may not be used. Accounts that are delinquent for a whole month will
automatically have their files archived. Accounts that delinquent for 2
months will have their files purged. Delinquent accounts continue to accrue
charges while they are on hold.
5.6) There is a service reconnection charge equal to one half the currently
charged set-up fee to remove accounts from accounting hold status.
5.7) The account holder acknowledges responsibility for the account
until payment is made in full.
5.8 ) There is a $15.00 service charge for any and all returned cheques.
6.0 ACCOUNT CANCELLATIONS
6.1) Cancellation requests for any or all ETHIO.COM services
purchasers must be received in writing via email, fax, or postal service
at ETHIO.COM main office. Such requests must be received by 5PM
Pacific time on or before the 15th of the month in order to be processed
by the beginning of the next accounting cycle.
6.2 ) All ETHIO.COM accounts must be paid in full before the
transaction will be considered complete.
6.3 ) Set-up fees and 1st Month Fee are non-refundable.
6.4 ) All cancellations require 30 day notice before cancellations
take effect.
7.0 ABUSE OF SERVICES
7.1) Any use of ETHIO.COM resources that disrupts the normal
use of the system for other ETHIO.COM customers is considered to
be abuse of system resources and is grounds for administrative intervention.
Some examples of system abuse include spawning dozens of processes, consuming
excessive amounts of memory or CPU for long periods of time.
7.2) Violations of any of the ETHIO.COM conditions of use are
unethical and may be criminal offences. You are expected to report to Yellow
Net Direct any information you may have concerning instances in which the
conditions of use have been or are being violated. When ETHIO.COM
becomes aware of possible violations, we will begin an investigation. At
the same time, in order to prevent further unauthorized activity, Yellow
Net Direct may suspend access to services to the purchaser(s) in question.
Confirmation of violations may result in cancellation of the individual
and/or criminal prosecution.
7.3) Failure to comply and abide with the above terms and conditions
may result in cancellation of contract.
